Pesudavil respects the intellectual property rights of others and expects users of its platform to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") describes how Pesudavil responds to claims of copyright infringement submitted in accordance with the Digital Millennium Copyright Act.
1. Notification of Claimed Infringement
If you believe that content available on or through our platform infringes one or more of your copyrights, please submit a written notification ("Takedown Notice") containing the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is claimed to have been infringed.
- Identification of the copyrighted work or works that you claim have been infringed. If multiple works are covered by a single notification, a representative list of such works is acceptable.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including information reasonably sufficient to permit us to locate the material.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please be aware that if you knowingly misrepresent that material or activity is infringing, you may be liable for damages, including costs and attorneys' fees, under applicable law.
2. Counter-Notification
If you believe that material you posted on the platform was removed or access to it was disabled by mistake or misidentification, you may submit a written counter-notification ("Counter-Notice") to our designated agent. To be effective, a Counter-Notice must include the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of a competent court for the judicial district in which your address is located, or if your address is outside of the applicable territory, any judicial district in which we may be found, and that you will accept service of process from the person who provided the original Takedown Notice or an agent of such person.
Upon receipt of a valid Counter-Notice, we will forward it to the party who submitted the original Takedown Notice. That party will then have a period of time to seek a court order restraining you from engaging in the infringing activity. If we do not receive notice that such a court order has been sought, we may restore the removed material at our discretion.
3. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Pesudavil has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. Pesudavil may also, at its sole discretion, limit access to the platform or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
4. Modifications to Submitted Content
When Pesudavil removes content in response to a Takedown Notice, we may notify the user who posted the content that it has been removed. We reserve the right to make such notifications at our sole discretion.
5. Accuracy of Notices
Submitting a Takedown Notice or Counter-Notice is a legal action. Notices that contain false or misleading information, or are submitted in bad faith, may result in civil liability. Pesudavil encourages you to consult with a qualified legal professional before submitting any notice to ensure that your claim is valid.
6. No Legal Advice
Nothing in this DMCA Policy constitutes legal advice. If you are uncertain about whether specific material infringes your copyrights or the copyrights of others, we recommend consulting a qualified attorney.
7. Changes to This Policy
Pesudavil reserves the right to modify this DMCA Policy at any time. Changes will be effective upon posting to the platform. Your continued use of the platform following the posting of any changes constitutes your acceptance of the revised policy.
